Terms of Service
These terms are an agreement between you and Sebastian Zimola (“we”, “us”), the seller of EverScrape (the “Software”). By buying, activating or using the Software you accept these terms. If you buy for a company, you accept them on its behalf.
1. The Software and your license
- We grant you a personal, non-exclusive, non-transferable license to use the Software on one computer per license key, for as long as your license is active (see section 3).
- You can move your license to another computer by deactivating it on the old one (up to 2 moves in total; after that, contact support).
- You may not share, resell, rent or publish your license key, or copy, modify, decompile, reverse engineer or circumvent the license check of the Software, except where the law expressly allows it.
- Referral license keys earned through the referral program (section 6) may be given away or sold by the person who earned them; the buyer then uses them under these terms.
- The Software includes third-party open-source components, licensed under their own terms (see the license file inside the application). Nothing in these terms limits your rights under those licenses.
2. Prices and payment
Prices are shown on our website in US dollars before checkout. Payments are processed by Whop, which stores your payment method; we never see or store your full card number. Taxes may be added where required.
3. Plans
Free trial. A free license lets you collect up to 1,000 leads (scraped and validated) on one computer, without a payment method. One free trial per computer. When the limit is reached, searching stops until you choose a paid plan; the leads you collected stay yours. Upgrading keeps the same license key.
Lifetime. One payment. Your license never expires.
Monthly (“pay less every month, then it's yours”). You pay the first amount at checkout. By choosing this plan you authorize us to charge the saved payment method automatically every 30 days with the following amounts until the plan is paid off: $80, $70, $60, $50, $40, $30, $20, then $10 (after the first payment of $90). The schedule is shown before you pay and in your account. After the last payment your license becomes a lifetime license and no further charges are made.
- Failed payments. If a charge fails, we notify you and retry. The Software keeps working for 15 days; after that it is paused until the open payment is made. You can pay or change your card any time in your account.
- Cancelling. You can cancel any time online in your account. No further charges are made and the Software works until the end of the 30-day period you have paid for. Amounts already paid are not refunded (except under section 4) and do not carry over: if you return later, the plan starts again from the first payment.
- Offers. When you cancel we may offer a discount on your next payment. If you accept, the discount is spread over your remaining payments and shown in your account before it applies. You can always decline and cancel.
4. Refunds
If the Software doesn't run on your computer, contact us within 7 days of your first payment for a full refund. Apart from that, payments are non-refundable except where the law requires otherwise. A refunded license stops working (the leads you already collected stay yours). A chargeback or payment dispute without contacting us first may lead to the license being disabled.
5. Your responsibilities
- The Software collects publicly available business information from the internet on your computer and with your internet connection. You decide what you search for and how you use the results.
- You are solely responsible for complying with all laws that apply to your use, including telemarketing and messaging laws (for example the US Telephone Consumer Protection Act, state telemarketing laws, carrier 10DLC rules, CAN-SPAM), data-protection laws (for example GDPR) and the terms of the websites the data comes from. Get the consent your use requires and honor opt-out requests.
- You may not use the Software for unlawful purposes, harassment, spam or to resell its output as a competing service.
6. Referral program
- Every license holder gets a personal referral link. You earn the commission rate shown in your account on each payment made by customers who buy through your link. Commissions become payable 14 days after the payment and are paid out monthly to the Whop account you specify. Refunded or disputed payments earn no commission.
- For every 4 customers who buy through your link and make their first payment you earn one license key you may keep, give away or sell. If you are still on the monthly plan, your first such reward also waives your remaining payments.
- Self-referrals, spam, misleading claims, bidding on our brand name and incentivized fake sign-ups are not allowed. When you promote your link you must clearly disclose that you earn a commission.
- We may change or end the program with notice; commissions already earned remain payable unless obtained in breach of these terms.
7. No guarantee of results
Line-type checks (mobile, landline, VoIP) are based on number-assignment data and are estimates: numbers ported to another carrier may show their original type. Search results depend on third-party websites, which can change or limit access at any time. We don't guarantee any number of leads, sales or other results.
8. Updates and support
We provide updates and e-mail support at sebastian@setwell.net for active licenses. Updates are offered inside the Software and installed with one click; your license, leads and settings stay as they are. The Software checks your license online at start and periodically; it keeps working offline for up to 3 days.
9. Disclaimer and limitation of liability
To the extent permitted by law, the Software is provided “as is” without warranties of any kind. We are not liable for indirect or consequential damages, lost profits, lost data, or for fines or claims arising from your use of the results. Our total liability is limited to the amounts you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law or your mandatory rights as a consumer.
10. Suspension and termination
We may disable a license that is shared, resold in breach of these terms, obtained by fraud or charged back. You may stop using the Software at any time.
11. Governing law
These terms are governed by the laws of the Czech Republic, without prejudice to the mandatory consumer-protection rules of the country where you live.
12. Changes and contact
We may update these terms; the version that applied when you bought stays valid for that purchase, and we will tell you about material changes by e-mail. Questions: sebastian@setwell.net.
